1. Object

These general conditions of sale, hereinafter referred to as "GTC", are concluded between Sagapo Bijoux, hereinafter referred to as the "seller", and any natural or legal person wishing to make a purchase via the sagapobijoux.com website, referred to as hereinafter the "customer".

 

The parties agree that these T & Cs exclusively govern their relationship, from ordering to after-sales service, including payment and delivery. Thus, any order placed on the site therefore implies the customer's unreserved acceptance of the GTCS. These are liable to be modified and updated, however the applicable conditions will be those in force on the date of the buyer's order.

 

Sagapo Bijoux is a sole proprietorship, created in 2021 by Blandine Culot. It is registered in the Marseille Trade and Companies Register (RCS) under the number… Its individual tax identification number is… Its registered office is at 2 boulevard Marcel Delestrade, 13190 Allauch. Sagapo Bijoux is engaged in the creation, manufacture and retail sale of costume jewelry and other accessories related to jewelry. The sole proprietorship also offers a customer customizable jewelry design service.

 

All the elements that make up the sagapobijoux.com site are protected by French and international laws relating to intellectual property. Consequently, no one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether they are software, visual or sound, without the authorization of the seller.

 

 

2. Product characteristics and prices

The products governed by these GTC are those offered on the website. They are presented within the limits of available stocks. However, an order cancellation due to a stock error can exceptionally occur. The responsibility of Sagapo Bijoux cannot be engaged in the event of exhaustion of stocks, whatever the origin.

 

The photographs of the products for sale on the site are not contractual, they are displayed for illustrative purposes. However, the seller undertakes to reflect reality as accurately as possible. For this, each product is accompanied by a detailed description to best satisfy the customer's information. It is not excluded that an error may appear there, which the customer recognizes and accepts. He is also aware of the possible variation in the colors of the products presented on the visuals of the seller's website depending on the computer equipment used.

 

The prices of the products are expressed in euros all taxes included (TTC) excluding delivery costs. All customs duties or other local taxes that may be payable are the sole responsibility of the buyer and under his responsibility. The products remain the property of Sagapo Bijoux until full payment of the price.

 

The seller reserves the right to modify its prices at any time. However, the products will be invoiced on the basis of the rates in effect at the time of registration and payment of the order, subject to availability.

 

 

3. Terms of order and payment

Order taking on the site is subject to compliance with the procedure set up by Sagapo Bijoux, represented by a succession of steps that the customer must follow to validate his order. He selects and adds the products to his basket, chooses the address and the delivery method, and finally validates the payment method, this last step formalizing the sales contract between sagapobijoux.com and the buyer. Once confirmed and accepted by the seller, the order cannot be modified or canceled, except for the exercise of the right of withdrawal.

 

The customer can access the summary content of his basket at any time as long as the order has not been definitively validated so as to correct any errors in the data entry. The information given by the buyer when ordering is binding. In the event of an error in the wording of the recipient's contact details, the seller cannot be held responsible for the inability to deliver the product.

 

Upon validation of the order, the seller sends a summary e-mail, indicating the nature of the products ordered, the quantity and the price, to the e-mail address provided by the customer. To this end, the customer formally accepts the use of electronic mail for confirmation by the seller of the content of his order. In certain cases, in particular non-payment, incorrect address or other dispute concerning the buyer, the seller reserves the right to block the buyer's order until the problem is resolved.

 

The price is payable in cash by the customer, in full on the day the order is placed. Payment is made online, at the time of ordering, by Credit Card or PayPal. By choosing to pay via PayPal, the buyer will be automatically directed to the PayPal website. He is not required to have a Paypal account to be able to pay for his order. Once the Paypal payment has been validated, their order will be taken into account.

 

By credit card, the order validated by the customer will only be considered effective when the bank payment centers concerned have given their agreement. In case of refusal of the said centers, the order will be automatically canceled.

 

 

4. Delivery

The products ordered are delivered in metropolitan France, in the French overseas departments and territories and throughout Europe by post, by letter followed, to the address appearing on the buyer's order form. The shipment is made within a maximum period of 5 working days from the receipt of the price corresponding to the consideration by the seller (unless otherwise specified on the site). The time for the delivery of a letter followed in metropolitan France is about 48 hours and about 3 days for the main European cities (indicative times). Any delays do not entitle the buyer to claim damages.

 

In the event of an anomaly in delivery (package lost, damaged, opened, etc.), the customer must submit his complaint to the carrier, by registered mail, a copy of which will be sent to Sagapo Bijoux. These routing problems are to be resolved as a priority with the carrier, the seller can not be held responsible. The goods always travel at the risk and peril of the recipient.

 

All complaints relating to a defect in the delivered goods, an inaccuracy in the quantities or their incorrect reference in relation to the confirmation of the order, must be formulated by email no later than three days after receipt of the package to the after-sales service. at the following address: sagapobijoux@hotmail.com . The customer is required to attach all relevant supporting documents, particularly photographs. After this period and failing to comply with these formalities, the products will be deemed to comply and free from any apparent defect and no complaint can be validly accepted by the seller.

 

 

5. Right of withdrawal

In accordance with the Consumer Code, the customer has a period of fourteen days to exercise his right of withdrawal, from the day after receipt of the product by the customer, without having to justify reasons or pay penalties. The customer must inform the seller of his decision to withdraw within the period set out above by completing this withdrawal form and sending it to: sagapobijoux@hotmail.com .

 

The customer also undertakes to return the product (s), at his expense, within a maximum period of fifteen days from the communication of his decision to withdraw, to the following address: Sagapo, 2 boulevard Marcel Delestrade, 13190 Allauch. The product (s) are returned by the customer in their original packaging, intact, without having been worn or used. Products returned incomplete, spoiled, damaged, deteriorated or soiled by the customer will not be refunded, returned or exchanged.

 

Refunds for products will be made within a maximum period of 14 days after receipt by the seller of said products. The refund will be made according to the same method of payment chosen by the customer at the time of his order. The seller will reimburse the buyer for returned products only, indeed the shipping and handling costs of the package remain the responsibility of the customer.

 

In accordance with article L.221-28.3 ° of the Consumer Code, the right of withdrawal cannot be exercised for orders relating to products made to customer specifications or clearly personalized. The same applies to goods which have been unsealed by the customer after delivery and which cannot be returned for reasons of hygiene, such as earrings.  

6. Guarantees and responsibilities

The products are subject to a commercial warranty of 2 months, from the date of receipt of the order, with the exception of parts that have suffered damage, improper use or in the event of natural wear.

 

To benefit from the guarantee, the customer must send his request for support to the after-sales service at the following e-mail address: sagapobijoux@hotmail.com . In order to ensure a fast and quality treatment of his request, he is advised to indicate his contact details, his order number, the name of the product concerned as well as photographs of the defect of the product. After-sales service will contact them as soon as possible to tell them the procedure to follow. In the event that the requested repair is not covered by the warranty or if the warranty has expired, the seller may offer the customer, subject to the availability of parts, a paid repair.

 

All products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned, exchanged or refunded. Any defective item due to a manufacturing defect duly noted by the seller will be replaced free of charge. Beyond 24 months after the date of purchase, the labor related to the interventions will be invoiced, as well as the replacement of the parts.

 

The seller can not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is the customer's responsibility to check with the local authorities the possibilities of importing or using the products or services he intends to order.

 

The seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

 

The seller will be exempt from any liability in the event of total or partial breach, even temporary, of one or other of its obligations arising from this agreement, which would be caused by a case of force majeure. It is defined as an event of an insurmountable and irresistible nature, resulting from an event outside the control of the parties, which consists of an event or a series of events of a climatic, pandemic, bacteriological, military, political or diplomatic nature.

 

 

7. Dispute settlement

These General Conditions of Use are subject to French law. In the event of a dispute, the parties reserve the right, before any legal action, to seek an amicable solution. Otherwise, express jurisdiction is assigned to the French courts.

 

The client may have recourse to a mediator free of charge. To do this, he must send a written complaint to the seller's after-sales service. If the negotiations are not successful, and subject to Articles L. 612-2 and L.616-1 of the Consumer Code, refer the matter to the competent mediator.
